Terms and Conditions
User Agreement
The purchase and/or use of products and/or services from GTX Web Hosting constitutes acceptance of these Terms and Conditions, without modification, or exception. GTX Web Hosting reserves the right to modify these terms and conditions without notice.
It is your responsibility to ensure the Terms and Conditions are complied with in respect of the products and/or services we provide to you, including where inappropriate activity may be committed by a friend, family member, guest, employee, or another.
A breach of these Terms and Conditions may result in account suspension and could lead to termination.
Communications with you
It is your responsibility to keep your account information with us up-to-date at all times, including contact details. This must include an email address, which is independent from any email addresses we may provide you with as part of our service. This will be our primary means of communicating with you. The provision of false or fraudulent account information may result in the termination of your account.
Content of your website(s) and use of our services
You are wholly responsible for ensuring the contents of your website(s) and the use of GTX Web Hosting products and services complies with all applicable laws. GTX Web Hosting requires that you comply will all applicable laws in the use of our products and services. GTX Web Hosting does not accept any legal responsible for your use of our products and services.
We will periodically monitor the content of your website and the use of our products and services. Failure to comply with your legal obligations and/or these terms and conditions may result in the suspension and/or the termination of your account.
We expect our customers to use our services in a responsible and respectful manner, including towards other internet users and copyright owners. The following restrictions to the use of our products and services apply:
Our primary service to you is a "web hosting" service. Therefore all the content you place on our servers is to be hyperlinked and accessible via a web browser. The server is not intended for use as a FTP or backup service.
Sites of an adult nature are NOT acceptable on our servers.
All e-mail services and or sub domains are for your use. They are not to be re-sold or used for promotional offerings.
Servers
Our hosting services makes use of RAID servers with the aim of minimising the chance of data loss, or corruption. We backup the data on our servers, with the aim that the data on our servers can be restored in the event of a failure or other problem. However we offer no guarantees of this, or that the restored data will be absolutely identical to that prior to the failure. We therefore strongly recommend that you keep copies of your data off-site and that you operate your own backup strategy. To help you, cPanel incorporates a backup feature for the ‘home’ directory and also for databases.
If our systems fail, you are responsible for data restoration and the data integrity.
Payments
Our products and services must be paid for before use. We are not offering any form of credit. If your hosting account or service is activated before payment is made then payment must be made in full immediately.
We will contact you in advance using your registered email address to request payments as they become due, and to offer renewal of our services prior to expiry. Failure to make payment by the due date could result in your account being suspended.
Monthly payments will still be incurred by the user even if the account is suspended, and/or we have not received formal notice of cancellation. We collect all due debts.
Actions we may take against failure to pay may include:
During these periods we will endeavour to contact you. It is your duty to maintain accurate and update address, contact and billing information.
Should a credit card "chargeback" be performed on your credit card or a pay pal transaction reversed, we reserve the right to suspend your account and services
Account Suspension and Termination
You may terminate your account, on giving us at least 21 days notice, prior to your next payment date. If the termination date is prior to the minimum period for the account (1 year), then you will still be required to make payments until the expiry of the minimum period. You may make any such remaining payments either in accordance with original payment schedule, or as a one off payment.
A breach of these Terms and Conditions may result in account suspension and could lead to termination.
A suspended account will not be re-enabled until you have rectified the issue which caused us to suspend the account and the receipt of the administration fee (if requested by us). If an account is suspended or terminated, we reserve the right to charge an administration fee of £ 29 to re-enable it. This will be charged to your account.
GTX Web Hosting may terminate your account, or refuse to renew your account for any reason and will aim to give you at least 21 days notice. If termination was due to your breach of these terms and conditions, then no refunds will be given and you will still be liable to make any remaining payments for the minimum period for the account.
If GTX Web Hosting terminates your account for any reason other than breach of this agreement GTX Web Hosting may at its discretion offer a refund of fees for the remaining months for which you had pre-paid the fees, as calculated on a pro-rata basis.
Warranties and Liabilities
GTX Web Hosting will make reasonable efforts to operate and maintain our services. However as many events and circumstances affecting the services could be outside our control, GTX Web Hosting does not in any way warrant or guarantee the availability of the GTX Web Hosting systems and services and GTX Web Hosting will not be held responsible for any loss of data, limitations in connection speeds, or other issues, whether due to the negligence of GTX Web Hosting or otherwise.
The GTX Web Hosting products and services are provided to you on an “as is basis” and without any warranties or acceptance of any liabilities by GTX Web Hosting. No guarantees for fitness for purpose are provided. GTX Web Hosting will not accept and consequential losses incurred from using our products and/or services. GTX Web Hosting accepts no third party liability.
Domain names
All domain names registered, without web hosting, through us are the property of our customers for the period for which they have specified. Domains bought with web hosting cannot be resold or transferred before the end of the web hosting period. All domain names purchased with hosting will be registered under GTX Web Hosting’s details. However, at any time these details can be changed to those of our customers for a small fee of £5.00, but GTX Web Hosting keeps control of the domain name
Privacy Policy
All the data receive is deemed as private, and we never sell or share any of your personal information including email addresses. If a matter regarding any of our customers’ accounts becomes a legal matter and/or an object of litigation, we will disclose any information we might have to the proper authorities, as requested of us by law.
You may not use your account to breach the security or privacy of another account or attempt to gain unauthorized access to our servers, another network or server.
We are working hard to provide a high quality service. In return, we expect our customers to treat us with the respect and understanding that we are offering them. Abuse of our staff in any form is it by e-mail, phone, etc will not be tolerated and we reserve the right to cancel the service of anyone who would perpetrate this kind of behaviour on our staff.
